Community Foundation of South Alabama Real Estate Gifts Acceptance Checklist

 


Donor responsible for expenses incurred

Exact legal name of donor and federal identification number

Description of property (copy of deed)

Description of any buildings or other structures located on the land

Boundary survey of property with location of all structures, easements, and encumbrances appearing on the face of the survey

Information regarding existing zoning status

Information on ingress/egress for the property

Description of prior use of the property

Description of use of surrounding property, with specific disclosure of any storage tanks, or potential environmental factors effecting the property

Disclosure of any contemplated or anticipated condemnations, right-of-ways or other actions by municipalities that may effect the subject property

Phase One environmental report on the property, including environmental report on any structures located on the real estate, or any underground contamination or environmental liabilities or issues exist

Real property liability, Fire, Windstorm, Hurricane, and Extended coverage insurance policy insuring the CFSA I Property, LLC or CFSA Property II LLC as the owner

Evidence of title, such as title examination and report, title insurance commitment for full appraised value of property, or schedule describing any liens, encumbrances, or title matters effecting the property

Copy of appraisal showing the fair market value of the property current within sixty days

Disclosure of amount of existing real estate taxes, insurance premiums, and assessments attributable to the property

Discussion with proposed donor or donor’s attorney regarding any special arrangements for donor’s fund or other sources to address ongoing expenses for taxes, insurance, assessments, maintenance, grass cutting, security, utilities, and similar items.

An indemnity or hold harmless agreement if deemed appropriate by Executive Committee

Letter from the donor agreeing that the donor will contribute additional amounts if necessary to equal any additional expenses incurred by the Community Foundation in the ownership of the real estate.

A gift of real estate requires a review by the Real Estate Committee and by the Board of Directors before final acceptance is granted.
